Terms of Service

These Terms explain the rules that apply when you use Momori, including its local photo-diary tools and optional cloud AI features.
1. Agreement
These Terms of Service ("Terms") govern your access to and use of the Momori mobile application, optional cloud features, website, and related services (collectively, "Momori" or the "Service"). The Service is provided by the Momori team ("we," "us," or "our").
By downloading, accessing, or using Momori, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. The Momori service
Momori is a private photo diary that lets you take or import photos, apply film-inspired Moods, save entries with emoji, notes, or captions, revisit moments, and create exportable Story cards. Core diary content is stored on your device and no Momori account is required.
Momori may also offer optional cloud features, including AI-generated image variations and caption suggestions. These features require an internet connection and may be subject to availability, usage limits, or credits.
3. Eligibility
You must be at least 13 years old, or the higher minimum age required in your country, to use Momori. If you are not old enough to accept these Terms yourself, a parent or legal guardian must accept them for you where permitted by law.
4. License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use Momori for personal, non-commercial purposes on devices you own or control.
If you download Momori from the Apple App Store, your use is also governed by Apple's applicable App Store terms and the Apple Standard End User License Agreement, unless another license is presented to you. These Terms do not replace mandatory platform terms.
5. Your content
You retain any rights you have in the photos, text, and other content you provide to Momori ("Your Content"). You are responsible for Your Content and must have all rights and permissions needed to use it with the Service.
When you choose a cloud feature, you grant us and our service providers a limited, worldwide, non-exclusive license to host, copy, transmit, process, modify, and return the selected content only as needed to provide, secure, maintain, and troubleshoot that feature. This license ends when the information is deleted under our retention practices, except where retention is legally required.
Do not submit content that violates law; infringes intellectual-property, privacy, publicity, or other rights; exploits or sexualizes minors; contains unlawful sexual content; promotes violence or illegal activity; or attempts to abuse, disrupt, or bypass the Service.
6. AI features and outputs
AI features can produce unexpected, inaccurate, incomplete, or similar results for different users. You should review generated images and captions before saving, publishing, or relying on them. AI output is not professional, medical, legal, financial, or other expert advice.
Subject to applicable law and third-party rights, you may use outputs generated for you for personal purposes. We do not promise that an output is unique, non-infringing, or suitable for any specific use. You are responsible for how you use and share an output.
You may not use AI features to identify a person, infer sensitive traits, create deceptive or harmful content, violate another person's rights, or develop or improve a competing machine-learning model through automated extraction or scraping.
7. Credits, purchases, and refunds
Momori may include complimentary or paid feature credits. A credit represents a limited right to submit an eligible request; it is not money, property, or a transferable stored-value balance. We may set expiration, promotional, anti-abuse, or usage rules disclosed in the app.
If paid features are offered through an app store, the store provider handles payment processing, taxes, receipts, refunds, family sharing, and billing under its own rules. Prices can vary by country, currency, and platform and may change before purchase. We do not receive your full payment-card information.
Except where required by law or app-store rules, used credits and completed digital services are not refundable. If an AI generation fails before a usable result is returned, Momori may automatically restore the applicable credit.
8. Acceptable use
You agree not to:
- copy, modify, distribute, sell, lease, sublicense, or commercially exploit the Service except as permitted by us or by law;
- reverse engineer, decompile, or attempt to extract source code, models, prompts, assets, or non-public interfaces except where the law expressly permits it;
- interfere with the Service, probe its security, bypass limits or credits, impersonate another person, or attempt unauthorized access;
- use bots, scripts, or other automated means to scrape or overload the Service; or
- use Momori in a way that violates applicable law or the rights of others.
9. Intellectual property
Momori, including its software, interface, website, text, graphics, filters, templates, branding, and other materials, is owned by us or our licensors and is protected by intellectual-property laws. Except for the limited license above, these Terms do not grant you rights in the Service or our trademarks.
If you send feedback or suggestions, you allow us to use them without restriction or compensation, but you are not required to provide feedback.
10. Third-party services
Momori relies on third parties such as app stores, device operating systems, cloud hosting providers, and AI service providers. Their products may be governed by separate terms and privacy policies. We are not responsible for third-party services that we do not control.
11. Privacy
Our Privacy Policy explains how Momori handles information, including on-device storage, optional AI processing, retention, and your choices. By using Momori, you acknowledge those practices.
12. Availability, updates, and changes
We may release fixes, updates, or new versions; change, suspend, or discontinue features; impose reasonable limits; or change compatibility requirements. We do not promise that any feature, AI model, style, template, or third-party integration will always be available.
You are responsible for maintaining compatible devices, software, connectivity, and backups. Because core diary content is stored locally, deleting Momori, losing or replacing your device, or device failure may permanently remove content unless you have made your own device backup.
13. Disclaimer
To the maximum extent permitted by law, Momori is provided "as is" and "as available." We disclaim all express or implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and that the Service will be uninterrupted, secure, or error-free.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you. Nothing in these Terms limits mandatory consumer rights.
14. Limitation of liability
To the maximum extent permitted by law, the Momori team and its members, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from or related to the Service.
Where liability cannot be excluded, our total liability for claims relating to the Service will not exceed the greater of the amount you paid for Momori in the 12 months before the event giving rise to the claim or the minimum amount required by applicable law.
15. Suspension and termination
You may stop using Momori at any time. We may suspend or terminate access to online features if you violate these Terms, create risk or legal exposure, abuse the Service, or if suspension is required by law. Where reasonable, we will try to provide notice.
Deleting the app is the main way to stop using local features. Provisions that by their nature should survive termination—including intellectual property, disclaimers, liability limits, and dispute terms—will survive.
16. Governing terms and disputes
These Terms are governed by applicable law, without limiting any mandatory consumer protections available where you live. Any dispute that cannot be resolved informally will be handled by a court with lawful jurisdiction, unless applicable law requires another forum or process.
Before filing a formal claim, please contact us and give us a reasonable opportunity to resolve the issue.
17. General
If any provision of these Terms is unenforceable, the remaining provisions will remain in effect. A delay in enforcing a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or transfer of the Service.
These Terms and the Privacy Policy are the entire agreement between you and us concerning the Service, except for additional terms presented for a specific feature or required by an app store.
18. Changes to these terms
We may update these Terms as Momori changes or as required by law. We will change the "Last updated" date and provide additional notice when appropriate. If you do not agree to revised Terms, stop using the Service.
